1. The arson
According to Article 114, Paragraph 1 of Article 115 of the Criminal Law and Article 1 and 2 of the Amendment to the Criminal Law (III), the crime of arson refers to the act of deliberately setting fire to public or private property and endangering public safety. According to the State Forestry Administration and the Ministry of Public Security on Jurislation and Filing Standards for Criminal Cases of Forest and Terrestrial Wild Animals, those who intentionally set fires and cause forest or other forest fires should be put on record.
2. The fire
According to the second paragraph of Article 115 of the Criminal Law, the crime of fire refers to the act that the wrongdoer causes a fire, causing serious injury or death, or causing heavy losses to public and private property, and endangering public safety. Article 1 of the Provisions of the Supreme People´s Procuratorate and the Ministry of Public Security on the Standards for Filing and Prosecution of Criminal Cases under the Jurisory of the Public Security Organs (I) stipulates that if a fire is caused by negligence and suspected of one of the following circumstances, it shall be filed for prosecution.
Causing death to one or more people or seriously injuring three or more people; Causing direct economic losses of more than 500,000 yuan to public property or other people´s property; Causing the houses of more than ten families and other basic means of living to be burned down; Caused a forest fire with an area of over two hectares of forested land, or an area of over four hectares of overheated forested land, shrub land, virgin forested land, or nursery land; Other circumstances causing serious consequences.
